Facts

The appellant drew out his matchet and cut the throat of the deceased simply because the deceased had caused him to spill some gari. He was convicted of murder and sentenced to dealt in the High Court and the Federal Court of Appeal struck out his appeal on a technical ground because he headed it Federal Supreme Court, he thereupon appealed to the Supreme Court.
